Welcome to ImThere. These Terms of Service (“Terms”) govern your use of the ImThere mobile application and related services (the “Service”) operated by ImThere (“we,” “our,” or “us”). By using ImThere, you agree to these Terms.

1. Acceptance of Terms

By creating an account or using the Service, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, do not use the Service.

2. Description of Service

ImThere is a social coordination app that allows users to broadcast their availability, share informal plans, and connect with friends for spontaneous hangouts. The Service is provided “as is” and may change over time as we develop new features.

3. User Accounts

You must provide accurate information when creating an account. You are responsible for maintaining the security of your account and for all activity that occurs under it. You must be at least 13 years old to use ImThere.

5. User Content

You retain ownership of content you post on ImThere (statuses, profile information, etc.). By posting content, you grant us a limited license to display it to your friends and contacts as part of the Service. You are solely responsible for the content you share.

6. Intellectual Property

The ImThere name, logo, app design, and underlying technology are owned by us and protected by intellectual property laws. You may not copy, modify, or distribute any part of the Service without our written consent.

7. Third-Party Services

ImThere may integrate with or link to third-party services (e.g., authentication providers, map services). Your use of such services is subject to their own terms and privacy policies. We are not responsible for third-party services.

8. Disclaimers

The Service is provided “as is” and “as available” without warranties of any kind, whether express or implied. We do not guarantee that the Service will be uninterrupted, secure, or error-free. We do not verify user identities or the accuracy of information shared through the Service.

9. Limitation of Liability

To the fullest extent permitted by law, ImThere shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or data, arising out of or in connection with your use of the Service. Our total liability shall not exceed the amount you paid us in the twelve months preceding the claim, if any.

10. Indemnification

You agree to indemnify and hold harmless ImThere and its officers, employees, and agents from any claims, damages, or expenses arising out of your use of the Service or violation of these Terms.

11. Termination

You may delete your account at any time through the app. We may suspend or terminate your access to the Service at our discretion, with or without notice, for conduct that we believe violates these Terms or is harmful to other users or the Service.

12. Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes through the app. Your continued use of ImThere after changes take effect constitutes acceptance of the revised Terms.

13. Governing Law

These Terms are governed by and construed in accordance with the laws of the State of California, United States, without regard to conflict of law principles.
